Data Use and Publication Policy
What you may do with what you receive from us. This policy applies to Deep Monitor, Market Intelligence and Custom Reports, and it survives the end of your subscription.
1. Definitions
Outputs means any scores, metrics, charts, timelines, exports, reports or API responses you receive from the service.
Symbioen Index means the composite reliability score produced under the methodology published at symbioen.com/methodology, at the version stated with the score.
Derived Material means analysis, models or documents you create using Outputs, where the Outputs are not themselves substantially reproduced.
2. What you may always do
You may:
use Outputs internally for any business purpose, including operations, maintenance prioritisation, investment analysis, procurement and planning; share Outputs internally, including with your group companies, at no additional charge; share Outputs with your professional advisers, auditors, lenders and prospective investors, under a duty of confidence, for the specific transaction or engagement concerned; create and freely use Derived Material; use Outputs as evidence in a dispute, arbitration, regulatory proceeding or tender to which you are a party; and retain Outputs you have already received after your subscription ends, for internal use and for the record.
The retention and dispute rights are deliberate. Evidence you cannot use in the dispute it was bought for would be worthless, and a term preventing you from reasonably using or keeping data you lawfully received would in any case be presumed unfair under the EU Data Act.
3. External citation
Where your Order Form states the data use tier as “Internal use and external citation”, you may quote Outputs publicly, provided that:
the figure concerns your own stations, network or portfolio, or is an aggregate market figure we have published; the quotation states the metric name exactly as we name it, the methodology version and the measurement period; attribution is included in the form set out in clause 6; the figure is not presented as a certification, guarantee or regulatory approval; and the figure is not edited, rescaled, recoloured or combined in a way that changes what it says.
4. Restrictions
You may not, and may not permit anyone else to:
resell, sublicense, syndicate or otherwise commercially distribute Outputs, whether as a dataset, a feed or a product feature; publish a named third-party operator’s score outside the context in which we published it, or use Outputs to construct a public ranking of third parties; use Outputs to train, fine-tune or evaluate a machine learning model intended for distribution outside your organisation; use Outputs to build or operate a service that competes with Symbioen; scrape, bulk-download or systematically extract the service beyond the export functions provided, or circumvent rate limits; or remove or obscure attribution, methodology version markers or ineligibility notices.
The restriction on publishing third-party scores matters most. A score lifted out of its context and used against a competitor damages the independence that makes the number worth quoting in the first place — including when you quote your own.
5. Independence of the Index
The Symbioen Index is produced independently. You acknowledge and agree that payment of fees confers no influence over any score, ranking or published result, including your own; that you have no right to require us to withhold, delay, amend or remove a score, and no right of prior review of anything we publish; that we may publish scores concerning you, including scores that reflect poorly on you, on the same basis as we publish scores concerning anyone else; and that ending your subscription does not remove your stations from public scoring, which is based on public data.
Correction requests
You may at any time submit a factual correction request, identifying the station, EVSE, period and the specific factual error alleged. We will assess it under the published methodology and respond in writing within 10 business days with our conclusion and reasoning. We correct genuine factual errors and republish where appropriate. A disagreement with the methodology is not a factual error.
6. Attribution
Where attribution is required, use one of these forms.
Short form, for a chart or a slide: “Source: Symbioen, Symbioen Index v0.5, Q2 2026.”
Long form, for a report or public document: “Source: Symbioen. Symbioen Index v0.5, measured Q2 2026, from public National Access Point data under the methodology at symbioen.com/methodology.”
The version and period in these examples are illustrative. Always cite the methodology version and measurement period stated with the figure you are quoting.
Do not substitute other names for the metrics. Use “Symbioen Index”, “Charging sessions”, “Successful charging sessions” and “public EV charger availability” as published. Do not use “Symbioen Reliability Index”, “Reliability Index” or “Index” alone.
7. After your subscription ends
You keep Outputs you already received and may continue to use them internally under clause 2. External citation rights under clause 3 end, except that material already published in good faith may remain published. You must stop describing any figure as current after the date your subscription ended. Clauses 4, 5 and this clause 7 survive termination.
8. Breach
If we reasonably believe you are in material breach of clause 4 or clause 5, we will notify you in writing with the specifics. If the breach is not cured within 15 business days, we may suspend the affected product. We will not suspend without notice and an opportunity to cure, except where continued access would cause serious and irreparable harm.
